1. Usage of the web site

Usage of the web site www.solvillaspain.com is limited to private use and a commercial exploitation will not be accepted. You have no rights to make copies of the page or of parts of it, nor to present it, publicise it, expose it, change it or create a page, which is based on it without the permission of Sol Villas Spain The right to use the website for searching for information or making bookings is only given to persons above 18 years, individuals, juridical persons, or representatives of institutions or companies. We reserve the right to change the website or parts of it and its content whenever we consider it necessary. Although every effort has been made to ensure the accuracy of the information give on the website, the information provided is only informative material and is dependent on a third party. As such we cannot be held responsible for the information.

2. Reservations / Bookings

Sol Villas Spain accepts requests only through telephone calls. All questions regarding confirmations, services details and cancellations must be made by then. With making a reservation the prospective customer agrees to commence a contract according to the (here-in) conditions and will be referred to as client. By confirming the booking (in the name of Sol Villas Spain) by e-mail, fax or mail a valid contract is made. The client has to verify that all the dates in the confirmation email are correct and to notify Sol Villas Spain within three days of any possible changes. Failure to notify us within this period will mean that the client accepts the reservation as stated. The correction of mistakes due to typing or calculation errors is reserved. The client has the sole responsibility to all obligations, which could follow the contract and will be responsible for all the persons included in his/her reservation. Accommodation: The availability of the accommodation is updated every day from Monday until Friday. If nevertheless you as a user request a booking from Sol Villas Spain and the housing is already booked out we will inform you immediately with the alternatives available.

3. Rates

All rates are quoted in euros (€) and will always be confirmed when Sol Villas Spain contact the client. Before booking you will be given the total price, as well as a breakdown of the amounts you are paying for. Additional charges accommodations: The accommodation costs do not include: Transfer between airport and accommodation, excursion and other personal expenditure.

4. Cancellation

Cancellation:

Please note that our cancellation charges depend on the amount of advance notice given prior to the arrival date at the property reserved. All cancellations must be made in writing by email or by fax. Unfortunately cancellations by phone cannot be accepted. Our Customer Service opening hours are 09.00 to 17:00 (local time in Malaga) from Monday to Friday. Unfortunately we are not open on Spanish Bank Holidays. Any cancellations sent to us outside these working hours will be considered as “received” on the date of the next working day. The cancellation policy applies to all amounts paid and/or confirmed by the client up until the date of cancellation including pre or partial payments/deposits.

This is the cancellation policy for all properties unless specifically stated in the description of the property itself. In such cases the cancellation policy for the specific property reserved will be applied.

We recommend that you obtain insurance that will provide you with cover should you need to cancel your travel plans.

Change Policy:

Changes in reservations may include change of arrival or departure date, destination, number of guests and property or property type reserved. In order to make a change to your reservation it will be necessary to cancel the booking you have already made and then make a new reservation. In situations where the cancellation of the reservation causes a reduction of the services contracted with a particular property, Sol Villas Spain reserves the right to apply the cancellation charge as specified above.

The administration charge that will be applied by Sol Villas Spain is detailed below:
  • 1st change to a reservation Administration charge of 0€
  • 2nd and/or successive changes Administration charge of 20€ +16% IVA per change

Should Sol Villas Spain fail to receive the administration charge and any applicable cancellation charges in advance of the arrival date, we will be obliged to cancel the reservation for failure to comply with accepted Terms and Conditions. In case of such a cancellation, the Cancellation Policy as detailed above will apply.

We recommend for these reasons that you take out travel insurance.

5. Force Majuer

The tenant is not freed from the responsibility of payment due to personal circumstances or force majeur such as war, strikes or natural catastrophes.

6. Check in / Check out Accommodation

If you have booked an accommodation you should go directly to the address indicated in the accommodation confirmation received from Sol Villas Spain. Your keys will be where stated. Check in time is from 16:00. Check out must be before 10:00hrs. In case of a delay in the occupation of the accommodation, or in case of an unanticipated earlier departure, there will not be any change of the total rental price. It is not permitted to stay in the accommodation with persons other than those mentioned on the booking form or those who are with you on arrival. Any change of persons during the stay is strictly forbidden, except when prior to arrival permission, has been asked of the contact person and granted by him. Furthermore it is not permitted to stay in the accommodation with more people than mentioned in the booking confirmation. In such cases the landlord has the right to ask you to vacate the premises immediately.

7. Security deposit

A security deposit of £200 will be asked for each property. This will be refunded (subject to damage) within 2 weeks of the end date of your holiday.

8. During the stay

You will have to treat the accommodation you are renting out and all of the equipment that belongs to the accommodation with care. Possible rules of the accommodation and its environment have to be respected in all moments and you will also have to respect the neighbours. If there is any damage done to the accommodation or to the equipment in it, it has to be communicated immediately to the Sol Villas Spain contact person. You will be held responsible for any damage of the accommodation or the equipment, done by you or one of your travel passengers.

9. Domestic animals

Bringing along domestic animals normally is not permitted in all accommodations if not otherwise stated in the description of the accommodation. In certain cases (blind dogs, pets for psychological disturbed children, etc.) it is possible that the property owners will give special permission. Please inquire prior to reservation if you may bring along the animal.

10. Descriptions of accommodation

All information regarding the accommodation is provided by the property owner. Sol Villas Spain does its very best to verify this information and keep it up to date, but Sol Villas Spain can never be held liable for the content in the descriptions of the accommodation.

11. Claims Accommodation

In case of claims against the accommodation you have to communicate them immediately to the contact person. If not you will lose all rights of compensation. If the reasons for the claim have not been eliminated in an appropriate period of time it has to be communicated to Sol Villas Spain any demand of compensation has to be presented in written form to Sol Villas Spain within one month. Later demands cannot be respected.

12. Responsibility

Sol Villas Spain acts as an agent for private accommodation owners. Therefore Sol Villas Spain can never be responsible for delays, accidents, losses, changes of schedules and rates, damages, etc. (neither for persons nor for objects),that may occur in any of its suppliers services.


Sol Villas Spain or its employees are not responsible for:
  • errors, omissions, or misspelled words
  • misrepresentation by third parties
  • personal damages or injuries incurred while staying in one of the accommodations of this Web site
  • disputes between a consumer and a third party
  • content of external links you will find on our website

13. Withdrawal by Sol Villas Spain

Sol Villas Spain can withdraw from the contract without any grace, if the tenant, regardless of a warning by Sol Villas Spain disturbs the peace or behaves contrary to the terms of the agreement in such a degree that the immediate annulment of the contract is justified. If we terminate for the reasons specified above, then our claim to the entire rent remains.

14. Notice

Any notice to Sol Villas Spain should be sent to info@solvillaspain.com or by fax to +34 951 273 498 (Spain) during normal business hours. You must promptly inform Sol Villas Spain of changes in the expiration date of any credit card used in connection with the services; changes in home or billing address; and any actual or suspected apparent breaches of security, such as loss, theft, or unauthorized disclosure. Until Sol Villas Spain is notified of a breach in security, you will remain liable for any unauthorized use of the services. Sol Villas Spain will provide you with copies of billing records documenting charges for use of the services upon request.

15. General

If any of these terms are determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive, remain in full force and effect and continue to be binding and enforceable.

16. Area of jurisdiction

These terms shall be governed by and interpreted in accordance with the laws of Spain 17. Trademarks Sol Villas Spain and other graphics, logos, and service names appearing on this site are the trademarks of Sol Villas Spain or its respective content suppliers. These trademarks may not be used in connection with any product or service that is not provided by Sol Villas Spain or by its respective content suppliers, in any manner that is likely to cause confusion amongst customers, or in any manner that disparages or discredits the company.
